Terms of Service

PsycheCyclops - Commission Terms of Service

Thank you for considering commissioning me! Below are my Terms of Service, including the entire commission process, what I expect to have from you as a client, and what you can expect from me as your artist. Please take the time to read and review this document before you submit payment.

By paying your invoice, you are hereby agreeing to my terms of service:

1. Contact and Information

a. Contact is possible for private commissions through several different websites/social medias, including: Discord (psychecyclops), Telegram (@PsycheCyclops), FurAffinity, Twitter, Instagram, and email ([email protected]). Discord is the quickest way to reach me.

b. Feel free to submit a commission form at any time, whether or not I state that my commissions are currently 'open'. I will let you know when slots are becoming available and when I am able to accept your commission.
_{bI. I organize my queue a week before the new month begins. If I have enough existing enquiries, I will not make a public post to 'open'.
bII. Ko-Fi Crystalline members will get the first notification that slots are open for the upcoming month. You can join my ko-fi crystalline tier here.}
c. Harassment and haggling will not be tolerated under any circumstances.
d. Communication is to remain professional between both parties, especially in the experience of discourse.

2. Submitting your Enquiry

a. When first contacting me and submitting your ideas, please have the following information ready:
_{aI. The type of commission you are wishing to buy (ex: Reference sheet, discord emotes, shaded full body, etc.)
aII. References and/or descriptions of the character(s) to be drawn
aIII. References and/or descriptions of the expressions and/or poses to be drawn
aIV. References and/or descriptions of the background (if applicable)}
b. Base prices for each commission and commission tiers can be found on my current price sheets. These are posted across all previously stated platforms in Section 1a, as well as Trello.
c. Additional charges may be made to the price for the following:
_{cI. Complex character designs (ex: wings, multiple appendages, detailed tattoos, excessive markings, etc.)
cII. Complex background designs
cIII. Foreshortened and/or Dynamic poses
cIV. Character(s) that do not have a pre-existing reference sheet or art}
d. Receiving a quote means that I am willing to do your commission in the foreseeable future. I will break down the pricing if any of the additional charges above apply to your piece(s).
e. Unforeseen events, emergencies or issues that prohibit me from working on art and delays progress will be communicated to my clients via direct messages, post(s) social media and posted as an update on Trello.

3. YCHs

a. YCHs (“Your Character Here”s) are set poses and backgrounds where I will simply draw your character in the place of the empty YCH.
b. In the description of the YCH post, I will specify which characters will fit into the piece by species and body type.
c. The YCH post will also specify how many slots are available for said YCH and/or how long it will be available. After these slots are filled or the cut-off date arrives, I will no longer be selling that YCH.
d. YCHs have set prices, but may fall into additional charges stated previously in Section 2ci.

4. Payment

a. Payment is to be made through Paypal via Invoice in EURO. No exceptions.
b. For commissions under 200€, the complete invoice must be paid in full before I am able to move you into the queue.
c. Commissions over 200€ are eligible for payment plans with a 200€ initial down payment. Plans will be catered on a client-artist basis, discussed in direct messages. By paying the down payment, you are agreeing to your payment plan.
_{cI. Pieces over 200€ with payment plans will not be 100% completed or delivered until the entire payment is submitted.
cII. Pieces with Payment Plans will be worked on within the queue, but once they reach the threshold of the last payment, will be put back on hold until the next payment has been made.
cIII. Example: If you pay for 50 emotes (410€), putting down the first 200€ will mean that 24 emotes will be drawn before I stop working on your piece (until the next invoice and payment has been sent).}
d. There is an upcharge for NSFW artwork. This starts at 15€ (unless otherwise stated on the pricing pages), but may increase due to complexity.

5. Artistic Process

a. Once payment has been received, you will be moved into the queue (found on Trello). Commissions are completed mostly in payment order.

b. By PayPal’s Terms of Service, I will deliver your finished work within 180 days.
c. I require my clients to contact me during the entire artistic process in order to approve the sketch, line art, and color stages.
d. Major revisions are to be discussed in the sketch phase. I am happy to make any and all changes during this phase.
e. Demanding a large change after the sketching phase will result in an additional fee to cover for time loss. Pricing for these changes depend on how drastic the change is.

6. Delivery & Shipping

a. Digital pieces are to be delivered through the social media where you have contacted me. However, I am happy to also send you the full file(s) via email or through Google Drive.

aIII. Telegram sticker packs can be organized and made by me for your convenience upon request.
aIV. Discord emote and Telegram sticker bundles also come with a complementary compilation piece for ease of posting.}
b. Physical pieces will always be sent with a tracking number to ensure correct shipping and handling. Prices may vary depending on the commissioner’s location.

bI. If the piece is lost or damaged, please contact me with written and/or photographical proof. I am happy to resend you a new piece for the price of materials and shipping.~

7. Refund Policy

a. Once the commission process begins, a percentage of it is non-refundable. This varies depending on how much work is completed. If you wish to cancel your order, the following rates will remind non refundable:
_{aI. sketch = 25% of the commission price
aII. outline = 50% of the commission price
aIII. flat color = 75% of the commission price
aIV. shading = 100% of the commission price}
b. If I do not start your piece within 180 days of your PayPal invoice being paid, you are subject to a full refund at your request.

8. Disclaimers

a. I reserve the right to deny anyone of my services.
b. I reserve the right to blacklist anyone from commissioning me for any reason.
c. I reserve the right to cancel and refund a commission for reasons relating to Section 1c. Said refunds also follow the same non-refundable percentages stated above in Section 7a.
d. I reserve the right to post and publish the finished commission, as I hold the initial creative copyright. Characters are not subject to copyright and will be linked back to you.
e. You, the client, have no right to sell, render, transform or reproduce the finished work without my, the artist’s, written permission.
_{e1. For commercial licensing, please refer to section 9.}
f. I refuse to draw the following themes/topics:
_{fI. Heavy gore, zoophilia, pedophilia, cub art, cub porn, pregnancy porn, vore, inflation, scat, water sports, and human-anatomy feet, among other fetishes/themes that make me uncomfortable.
fII. If you, the client, are unsure if I, the artist, will draw a specific theme/fetish for you, feel free to ask.}
g. Commissioners must be over the age of 18 to purchase NSFW art. No exceptions.
h. Under no circumstances are you allowed to use my art for AI training and/or models, whether it be from your personal commissioned piece or otherwise.
i. Under no circumstances are you allowed to use my art for the production of NFT's, whether it be from your personal commissioned piece or otherwise.

9. Commercial Licensing

a. Any pieces that are intended to be sold as a product by the client must be proposed upfront before the art is created.
_{a1. This is due to several factors: specific sizing for production, resolution, being print-ready (CMYK), and most importantly: reaching a price agreement that is fair for both the artist and client.
a2. If the client has an existing art piece from the artist that they wish to convert into a commercial revenue, there is a likelihood that the piece may need to be redrawn from scratch, thus requiring new, separate payment.}
b. Commercial license agreements will be agreed upon between artist and client before the art process begins.
c. Commercial licenses will either be based on a flat fee, or a percentage of sales.
_{c1. For a flat fee, the price of the commercial license will be at least 200%+ of the original price.
c2. For a sales percentage contract, the artist and client will agree upon to either: sending the percentage of sales within a certain amount of time (ex: monthly, quarterly, etc) OR within a certain number of sales.
c3. Pricing will depend on multiple factors, including (but not limited to): the product being sold, if the product is solely based around the art and nothing else, and revenue projection.}
d. The artist retains copyright over all works, including those with copyright licenses.
_{d1. This will allow the artist to post the finished work to their portfolio, socials, or use it for advertising their work.
d2. In the case of keeping a piece under non-disclosure agreements, the artist will withhold posting the art before the agreed-upon date set with the client.}
e. By paying the commercial licensing fee, the client is also allowed to use the produced artwork in their own promotions, so long the proper credit is given to the artist for producing the piece.
_{e1. This includes: advertisements on social media, at conventions, brand visibility, or marketing materials.}
